Legal Policies for Autônomo (Bakonsul LDA.)


1. Terms and Conditions of Service

Autónomo is an online negotiation environment in which individuals and companies participate with the purpose of agreeing on terms related to the execution of a specific project or activity. These terms must be presented clearly, objectively, and preferably in Portuguese. The outcome of negotiations is the sole responsibility of the parties involved, and it is up to them to decide whether or not to conclude a given negotiation.

On this platform, each autónomo (freelancer) has the right to assume two roles: one as a Requester and the other as a Provider, and the same user cannot assume both roles within the same negotiation.


1.1. Acceptance of Terms

These Terms and Conditions ("Terms") govern the access and use of the Autônomo platform, including the website and mobile application (the "Platform"), owned and operated by Bakonsul LDA. By creating an account, you agree to comply with these Terms and all applicable Angolan laws.


1.2. Platform Description

Autônomo serves as a dual-purpose marketplace:

  • Freelancing: Facilitating project bidding between independent professionals ("Freelancers") and project owners ("Clients").
  • Recruitment: Assisting entities in identifying and hiring professional talent.

1.3. User Eligibility

Users must be at least 18 years of age and possess the legal capacity to enter into binding contracts. Businesses must be legally registered in their respective jurisdictions.


1.4. Account Types

There are two types of autónomo accounts, each with its own characteristics:

Autónomo Account

This is an account in which no credit limit (plafond) is subscribed. In this type of account, the choice of payment method as well as the settlement of the contract or transaction is the sole responsibility of the parties involved in the negotiation.

Autónomo Classified Account

This is an account that includes a credit limit. You may need a credit limit in your autónomo account to use certain Autónomo Services, and it may be required for you to gain greater credibility during negotiations.

With a credit limit associated with your account, you have access to a direct and valid payment method visible to all autónomos. A Boss account allows you to receive a wider range of business opportunities that ensure greater credibility and profitability on the platform.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.


1.5. Communications and Other Content

You may post reviews, comments, suggestions, ideas, questions, or other information, provided the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing intellectual property rights (including publicity rights), or otherwise harmful or objectionable to third parties.

The content must also not contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam" or unsolicited electronic messages.

You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any content. Autónomo reserves the right (but not the obligation) to remove or edit such content.


1.6. Intellectual Property Complaints

Autónomo respects the intellectual property of others. If you believe your intellectual property rights are being violated, please follow our Notice and Procedure for Making Claims of Copyright Infringement.


1.7. Risk of Loss

All negotiations between autónomos are carried out in accordance with a contract for the execution of the project or activity. This means that the inherent risks of non-compliance with certain clauses by the parties are the sole responsibility of the parties involved.

Therefore, in negotiations involving a high level of risk, autónomos may contract the insurance and confidentiality service, which then assumes the risk of loss for one or all autónomos involved in the negotiation.


1.8. Renegotiations

Renegotiations occur when certain clauses of a project need to be revisited over time as the only means to safeguard the interests of the parties. Autónomo is not responsible for renegotiations unless they pertain to negotiations in which Autónomo is a primary party.


1.9. Product or Service Descriptions

Autónomo strives to be as accurate as possible. However, Autónomo does not guarantee that product descriptions or other content in any Service are accurate, complete, reliable, current, or error-free.

If a product offered by an autónomo is not as described, your sole remedy is to return it in unused condition.


1.10. Pricing

On Autónomo, negotiations may be conducted using fixed prices or variable prices. The advertised price of a project is the sole responsibility of the advertiser, who may change it as long as the listing remains active. The price may also be changed through renegotiation between the parties.

Price is considered a key element of any listing, and no listing may exist without a price.
